Real Estate Transactions: The most common real estate transaction involves a real estate agent who is usually paid by the seller. The agent typically drafts an Earnest Money Agreement using an area-approved form. Real estate agents are not attorneys. Buying a house is one of the most important transactions in one’s life; thus it is wise to have an attorney review these transactions. When someone wants to sell their property without a real estate agent’s assistance, it is common to consult an attorney to help with the transaction, including drafting an Earnest Money Agreement. An attorney can also draft a Real Estate Contract or a Promissory Note and Deed of Trust to secure the obligation to the seller when the seller is financing the purchase.
